NOTE WELL: THIS IS A “PAY” WEBSITE - UNFORTUNATELY, WE ARE NOT AND CANNOT BE A FREE WEBSITE.  LIKE MOST FREE THINGS, VALUE IS USUALLY LACKING   AND LIKE ANY SUCCESSFUL BUSINESS RUN IN THE PRVATE SECTOR, WE RELY ON MONETARY REVENUE TO PROVIDE THE INFORMATION AND SERVICES WE OFFER, AND TO KEEP THE WEBSITE UP TO DATE  AND AS ACCURATE AS POSSIBLE.  IF THE WEBSITE PROVES USEFUL, PLEASE CONTACT OUR OFFICE AND WE WILL QUOTE YOU A FEE FOR A COMPANY WIDE LICENSE AGREEMENT OR A ‘PAY AS YOU GO” ARRANGEMENT IF YOU ARE A SINGLE USER OR HAVE THE NEED FOR MORE THAN ONE USER CONCURRENTLY ON A GIVEN PROJECT OF LIMITED DURATION.

By signing up for a trial account and once you become a  paying subscriber to the www.ocsbbs.com website, you will be automatically added to our weekly email distribution list and also receive other industry related emails from time to time. We do not sell or generally provide our email lists to 3^rd parties, but rather use email to keep our members informed on industry related changes, topics, events, etc.  If you would like to discontinue receiving these emails, you can “opt out” in the manner provided or contact us in the manner listed below.

·  Ownership: All copyright and other rights in the information contained on this site are the exclusive property of Energy Data Solutions, LLC (EDS), owner of the OCS BBS.com Website. Trial User has no right to use, distribute, or reproduce any part except as provided herein. Written permission must be requested and granted to re-use any of our data for loading into another product as many of our databases are proprietary to our company and hundreds of hours in research time. At no time can you re-distribute to another vendor to add in their own product without written permission from us and an agreement in place to be fully compensated for our work product.

·  Trial Use of EDS Services and the OCSBBS Website (Trial Users Only): First, Trial User agrees to provide his or her real contact information to setup your trial account.   Trial usage periods of time are generally limited to 3 days or 100 hits, whichever comes first, although the trial user period may be extended in the sole discretion of the management of the website.  Trial Users may not use any more of the materials, data, and reports gleaned from the website or any information contained therein for any purpose whatsoever other that reasonably required to evaluate the website for potential license or single use agreement.   In other words, please do not attempt to use the website unreasonably without arranging for payment of an appropriate user fee.  This can be accomplished by calling our office at 504-733-3117 or emailing us at info@ocsbbs.com.  EDS, at its sole discretion, may terminate any Trial User immediately and without notice for any violation of the terms herein.

·  Use of OCSBBS: Trial User may use the OCSBBS Website: a) for internal use and dissemination in evaluating the website for potential commercial use or license; or b) to generate materials to be disseminated to 3^rd parties as part of purchaser's ordinary business activities provided: i) EDS is given appropriate attribution (e.g. Source: www.ocsbbs.com and ii) the amount of EDS material use is reasonable, in the determination of EDS. Purchaser/Trial User may not use the OCSBBS for the purposes of engaging in a business activity in competition with EDS.

·  Compliance with Terms: EDS reserves the right to terminate this Agreement immediately upon any breach thereof by any User or Purchaser. EDS reserves the right to seek reasonable assurances from all Users and Purchasers of compliance with the terms of this agreement and to terminate all rights provided by this Agreement immediately upon the inability of said User or Purchaser to provide such assurances.

·  Confidentiality: Certain Database information material contains compilations of information gathered and maintained by EDS at considerable expense and effort and methods proprietary to EDS. User shall take reasonable precautions to protect the confidentiality of this material that shall be at least equal to the precautions taken by User to protect its own proprietary information of a like nature.

·  Disclaimers: The OCSBBS contain information and data which are compiled from sources believed by EDS to be accurate and reliable. However, EDS does not guarantee their accuracy or reliability or the completeness of any of the datafiles or reports on OCSBBS.  The OCSBBS Website is provided "as is" without any express or implied warranty. EDS reserves the right at its discretion to alter the timing, number, content and production schedule of the datafiles and reports in a manner that EDS believes will not materially reduce the scope and content of the our services in the aggregate.

·  Limitation of Liability: PURCHASER AGREES THAT EDS SHALL NOT BE LIABLE FOR ANY DAMAGES OR INJURY, INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE EDS SERVICES AND EDS SHALL NOT BE RESPONSIBLE FOR OR HAVE ANY LIABILITY FOR ANY INJURIES OR DAMAGES CAUSED BY ERRORS, INACCURACIES, OMISSIONS OR ANY OTHER FAILURE IN, OR DELAYS OR INTERRUPTIONS OF, THE EDS SERVICES, FROM WHATEVER CAUSE. IN NO EVENT SHALL EDS’ LIABILITY FOR ANY DAMAGES HEREUNDER EXCEED THE AMOUNTS RECEIVED BY EDS AS A RESULT OF THIS TRANSACTION.
